General Terms and Conditions (GTC) of JLSPORT.DE GmbH
for the WEB Shop (online trade)
General / Scope of application
The following terms and conditions apply exclusively to all offers, deliveries and other services. We do not recognise any deviating conditions and regulations of the customer, unless expressly confirmed by us in writing. We reserve the right to amend or modify these General Terms and Conditions of Business at any time with reasonable notice. All offers, deliveries and other services shall be provided in accordance with the General Business Relationships in force on the day the order is placed.
Offers and conclusion of contracts
All offers are non-binding. We reserve the right to make minor deviations and technical changes. All offers and other services lose their validity with each new issue of the offers.
Prices
Unless otherwise agreed in writing, the gross purchase price is due for payment immediately upon receipt, but no later than 5 days from the invoice date. In the event of late payment, we reserve the right to charge interest at a rate of 5% above the current discount rate of the Deutsche Bundesbank, subject to the assertion of further damages for default.
Terms of payment

Prior receipt of payment is required for all orders. Articles of a team order will be released for production after the invoice amount has been received in full. WEB-Shop orders will be dispatched after the invoice amount has been received in full.
Delivery times
If non-compliance with an agreed delivery period is due to force majeure, industrial action, fire, machine breakdown, unforeseen obstacles or other circumstances for which we are not responsible, the delivery period shall be extended appropriately after prior consultation with the customer. In the event of non-compliance with the delivery period for reasons other than those mentioned above, the customer shall be entitled to withdraw from the contract.
Dispatch, delivery conditions and transfer of risk
Deliveries within Germany, to Austria and Switzerland will be made by GLS or by a forwarding agent or other person or institution appointed by JLSPORT.DE GmbH to carry out the shipment. For these deliveries within Germany a standard flat rate of 5.90 Euro, for deliveries to Switzerland 16 Euro per order will be charged for postage, packaging and customs clearance, provided that no other shipping costs are shown separately. Shipping to Switzerland is with franking 20 (free domicile, duty unpaid, untaxed). The customs clearance fee (presentation commission), customs duties and VAT at the rate of 8% will be invoiced separately by Swiss Post.
Delivery to countries other than those indicated in the shop is not possible.
Cancellation policy
You have the right to cancel this contract within fourteen days without giving any reason. The revocation period is fourteen days from the day on which you or a third party named by you, who is not the carrier, have taken possession of the last goods.

by means of a clear declaration (e.g. a letter sent by post, fax or e-mail) of your decision to revoke this contract. You can use the attached model withdrawal form for this purpose, which is, however, not mandatory.
In order to comply with the withdrawal period, it is sufficient for you to send the notification of the exercise of the right of withdrawal before the expiry of the withdrawal period.
Consequences of cancellation
If you withdraw from this contract, we must repay you all payments that we have received from you, including the delivery costs (with the exception of the additional costs resulting from the fact that you have chosen a type of delivery other than the cheapest standard delivery offered by us), without delay and at the latest within fourteen days from the day on which we received the notification of your withdrawal from this contract. For this repayment, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; in no case will you be charged for this repayment.
We may refuse repayment until we have received the goods back or until you have provided proof that you have returned the goods, whichever is the earlier.
You must return or hand over the goods to us without delay and in any case no later than fourteen days from the day on which you notify us of the cancellation of this contract. The deadline is met if you send the goods before the expiry of the period of fourteen days.
The customer shall bear the costs of returning goods.
You will only have to pay for any loss in value of the goods if this loss in value is due to your handling the goods in a way that is not necessary for checking the condition, properties and functioning of the goods.
Under current law, there is no right of withdrawal for contracts for the delivery of goods that are not prefabricated and for whose manufacture an individual selection or determination by the consumer is decisive or which are clearly tailored to the personal needs of the consumer.

Terms of payment
The invoices of JLSPORT.DE GmbH are to be transferred immediately after receipt without deduction to the indicated account. The services of JLSPORT.DE GmbH are subject to the legal value added tax.
Warranty
The warranty period is limited to the respective legally prescribed duration.
We guarantee that the sold goods are free of material and manufacturing defects at the time of the transfer of risk and that they have the contractually guaranteed characteristics. In the case of complaints, the date of purchase must be proven with an invoice. The item complained about must be sent in together with a copy of the invoice. The warranty does not cover normal wear and tear. We have the right to rectify defects free of charge during the warranty period. A partial or complete replacement of the item is permissible. If defects are not remedied within a reasonable period of time, the buyer shall be entitled to rescission (cancellation of the contract) or reduction (corresponding reduction of the purchase price).
Goods which are not prefabricated and for the manufacture of which an individual selection or determination by the consumer is decisive or which are clearly tailored to the personal needs of the consumer are excluded from exchange. The warranty right remains unaffected by this.
Data protection
As a matter of principle, JLSPORT.DE GmbH does not pass on any order data.
The personal data required in the course of business are processed electronically, stored and passed on to third parties to the extent necessary. You can request information about your stored data from the data protection officer (Michael (a) jlsport.de) of JLSPORT.DE GmbH at any time.
